These Terms of Service (“Terms”) apply to your access to and use of the website, online store, products, reservations, features, tools, content, and services operated by Daisy Audio Inc. (“Daisy,” “we,” “us,” or “our”).

Our store is powered by Shopify, which helps us provide the website, checkout, payment processing, and related ecommerce services.

Please read these Terms carefully. By visiting, accessing, interacting with, reserving a product through, or purchasing from our website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use our website or services.

By using our website or services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have the consent of a parent or legal guardian.

To use certain features of our website, reserve a product, place an order, or make a purchase, you may be asked to provide information such as your name, email address, phone number, billing address, shipping address, and payment information.

You represent and warrant that all information you provide to us is accurate, current, and complete, and that you have the right to provide that information.

Product descriptions, specifications, availability, pricing, promotions, and launch timing are subject to change at any time without notice. We reserve the right to discontinue any product or limit the quantity of any product offered to any person, geographic region, or jurisdiction.

Section 3: Reservations

Daisy may offer customers the ability to reserve access to purchase certain products before they are generally available.

A reservation is not a completed purchase of the product. A reservation may give you access to certain reservation benefits described at the time of reservation, such as launch access, a launch discount, priority shipping, or early access to select a color, subject to availability and the specific terms shown on the reservation page.

Unless otherwise stated at the time of reservation, your reservation amount will be applied toward your purchase if you choose to complete your order at launch.

If you decide not to complete your purchase, your reservation amount will be returned automatically after launch. Reservation amounts are not redeemable for cash and are not intended to be transferred, sold, or assigned.

We may also cancel and return a reservation if we are unable to fulfill the reservation, if the product becomes unavailable, if we discontinue the reservation program, or if we determine that the reservation violates these Terms.

Reservation benefits are personal to you and may not be transferred, sold, assigned, or redeemed for cash unless we expressly allow it in writing.

Reservation timing, product availability, launch timing, color availability, discounts, and shipping priority are estimates only and are not guaranteed. We reserve the right to change launch timing, product details, reservation benefits, or availability at any time.

Section 4: Orders

When you place an order, you are making an offer to purchase the products or services in your order.

Daisy reserves the right to accept or decline any order for any reason at our discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation or change requests after an order is accepted.

If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or phone number provided at the time the order was placed.

Purchases are subject to our Refund Policy and any return or exchange terms posted on our website.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or unauthorized export.

Section 5: Prices, Taxes, and Billing

Prices, discounts, and promotions are subject to change without notice.

The price charged for a product or service will be the price in effect at the time your order is placed and will be shown in your order confirmation. You represent and warrant that you are authorized to use the payment method you provide and that all payment information is accurate and complete. You agree to pay all charges incurred by you at the posted prices, including applicable taxes, shipping, handling, customs, import charges, and other fees where applicable.

Section 6: Shipping and Delivery

Shipping and delivery dates are estimates only and are not guaranteed.

We are not responsible for delays caused by shipping carriers, customs processing, import procedures, weather, labor disruptions, supply chain issues, incorrect shipping information, or events outside our reasonable control.

Unless otherwise stated at checkout, risk of loss passes to you when the product is transferred to the carrier.

For international orders, you may be responsible for applicable customs duties, import taxes, brokerage fees, and other charges imposed by your country or local authorities. These charges are not included in the product price or shipping cost unless expressly stated.

For reservations, unless otherwise stated, the reservation amount will be applied toward your purchase at launch if you complete your order. If you decide not to order, the reservation amount will be returned automatically after launch.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

Our website and services, including all trademarks, logos, product names, designs, text, images, graphics, renderings, videos, audio, page layouts, features, and content, are owned by Daisy, our affiliates, or our licensors and are protected by U.S. and international intellectual property laws.

Shopify’s name, logo, product names, and service names are trademarks of Shopify. All other trademarks appearing on our website are the property of their respective owners.

Our store is powered by Shopify. However, any reservation, sale, purchase, return, exchange, or customer relationship through our website is directly between you and Daisy.

By using our website and services, you acknowledge and agree that Shopify is not responsible for any aspect of the transaction between you and Daisy, including any injury, damage, loss, claim, or issue arising from products or services offered by Daisy.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your transactions with Daisy.

Subject to any rights you may have under applicable consumer protection laws, you and Daisy agree to the personal jurisdiction and venue of the state and federal courts located in Los Angeles County, California for disputes arising out of or relating to these Terms, our website, our services, reservations, or products.

We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. Where required by law, we will provide additional notice of material changes.
